Law on Amendments to Certain Laws of Ukraine Regarding the Formation and Maintenance of the List of Terrorist Organizations (Groups)

The law establishes the procedure for forming and maintaining a list of terrorist organizations (groups) in Ukraine. The Security Service of Ukraine, through the Anti-Terrorist Center, is empowered to form and maintain such a list. The mechanism for including and excluding organizations from the list, as well as the procedure for publishing relevant information, is defined.

Structurally, the law amends four laws of Ukraine: ‘On the Security Service of Ukraine’, ‘On Combating Terrorism’, ‘On Prevention and Counteraction to Legalization of Proceeds’, and introduces amendments to the Criminal Code. The main changes concern Article 24 of the Law ‘On Combating Terrorism’, which details the procedure for list formation.

Key provisions of the law:

• Inclusion of organizations in the list is based on information from international organizations, decisions of foreign competent authorities and courts, as well as verdicts of Ukrainian courts

• Clear timeframes are established for including/excluding organizations from the list – 15 working days or 3 working days depending on the grounds

• A list of open information about terrorist organizations subject to publication is defined

• Political parties registered in Ukraine cannot be included in the list

• Decisions on inclusion/exclusion from the list can be challenged in court
