The court was guided by the fact that from January 1, 2017, legislation established a separate procedure for paying a one-time monetary assistance to conscripted servicemen – the right to such assistance arises only during the period of service or no later than 3 months after discharge. Since the plaintiff was declared disabled many years after being discharged from conscript service (in 2021), there are no legal grounds for paying the one-time monetary assistance. The court also noted that the plaintiff did not exercise his right to receive insurance payment when initially assigned Group III disability in 1998.
