Ruling of the Grand Chamber of the Constitutional Court of Ukraine on the Consolidation of Constitutional Proceedings in the Case on Constitutional Complaints of Volodymyr Ivanovych Tymoshenko, Oleksandr Anatoliyovych Petrychuk Regarding the Conformity with the Constitution of Ukraine (Constitutionality) of Paragraph 1 of Part Five of Article 361 of the Code of Administrative Judicial Procedure of Ukraine and in the Case on the Constitutional Complaint of Iryna Mykhailivna Vasylieva Regarding the Conformity with the Constitution of Ukraine (Constitutionality) of a Specific Provision of Paragraph 1 of Part Five of Article 361 of the Code of Administrative Judicial Procedure of Ukraine

Ruling concerns the procedural issue of combining three constitutional complaints into a single proceeding, as they all challenge the constitutionality of the same provision – paragraph 1 of part five of Article 361 of the Code of Administrative Judicial Procedure of Ukraine.

Structurally, the ruling consists of three parts: 1) description of the current status of the cases being combined; 2) legal justification for the possibility of combining cases; 3) operative part with a decision on combining and appointing reporting judges.

Key provisions of the ruling:
– Combining cases is based on the third paragraph of part one of Article 76 of the Law of Ukraine “On the Constitutional Court of Ukraine”
– All three constitutional complaints concern the same issue – the constitutionality of paragraph 1 of part five of Article 361 of the Code of Administrative Judicial Procedure of Ukraine
– Reporting judges in the combined case are appointed: Kychun V.I., Sovhyria O.V., Filyuk P.T.
