Law on Amendments to Certain Legislative Acts of Ukraine Regarding Measures Aimed at Restoring the Rights of Convicted Persons and Persons Taken into Custody in Connection with Improper Detention Conditions

The law establishes a mechanism for compensating persons held in places of confinement for improper detention conditions. It provides for the possibility of reducing the sentence or monetary compensation for each day spent in inadequate conditions. Structurally, the law amends the Criminal Executive Code of Ukraine, the Law of Ukraine “On Pre-trial Detention” and the Criminal Procedural Code of Ukraine. The main innovations include: defining the concept of improper detention conditions, establishing the procedure for submitting and reviewing compensation claims, determining compensation amounts. Key provisions for application:

– For each day of detention in improper conditions, compensation of at least 120 hryvnias is provided or crediting one day of imprisonment as two days of punishment

– The compensation claim is submitted to the court at the place of serving the sentence

– Clearly defined criteria for improper detention conditions (area, lighting, ventilation, temperature, sanitary conditions, etc.)
