Subject of the dispute – consideration of an application to set aside a default court judgment regarding debt collection under a credit agreement. The court was guided by the fact that the defendant missed the deadline for filing an application to review the default judgment without valid reasons, as she was aware of the court decision since 2016, when debt collection began from her salary. The Grand Chamber of the Supreme Court deviated from previous practice and determined that when the deadline for appealing a default judgment is missed without valid reasons, the application should be left without consideration, rather than rejected on the merits. The court also took into account the principle of legal certainty, according to which appeal deadlines must be observed. The Supreme Court upheld the decisions of previous instances refusing to restore the deadline for appealing the default judgment and leaving the application without consideration.
