Subject of the dispute – recalculation of pension for a former prosecutor and determination of its amount. The court was guided by the fact that after the new Law “On Prosecution” No. 1697-VII came into force, the pension should be recalculated at 60% of salary (instead of 70% as previously) and that such pensions are subject to a maximum limit of no more than 10 subsistence minimums. In this case, the Supreme Court directly deviated from its previous legal positions regarding preservation of the percentage of pension that was in effect at the time of its initial assignment. The Supreme Court cancelled the decisions of previous instances and denied satisfaction of the claim for pension recalculation at 70% without a maximum amount limitation.
