Subject of the dispute – appealing a court verdict regarding the conviction of a person for theft of goods worth 909.84 UAH from a store during martial law. The court was guided by the fact that on August 9, 2024, a new law came into effect, which raised the threshold value of property for qualifying theft as a criminal offense to 2 non-taxable minimum incomes of citizens (2,481 UAH in 2022). Since the value of the stolen property was less than this amount, the act lost the characteristics of a criminal offense and became an administrative offense. In this case, the Supreme Court deviated from previous practice, referring to the resolution of the United Chamber of the Criminal Cassation Court of the Supreme Court dated October 7, 2024, which recognized this law as one that cancels the criminal unlawfulness of certain acts.
The Supreme Court revoked the verdict of the first instance court and the appellate court and closed the criminal proceedings against the accused.
