The court was guided by the fact that according to the new Law No. 3886-IX dated 18.07.2024, which came into effect on 09.08.2024, the limits of petty theft were changed – now it amounts to up to 2 non-taxable minimum incomes of citizens (previously it was up to 0.2). Since the value of the stolen property in both episodes was less than 2 non-taxable minimum incomes of citizens at the time of the offenses (2,481 UAH in 2022 and 2,684 UAH in 2023), the act ceased to be criminally punishable and became an administrative offense. The law has retroactive effect if it mitigates liability.
