The court was guided by the fact that the appropriate method of protecting the property rights of the territorial community is to file a claim for recovery of property against the last acquirer – a legal entity (LLC “Segesta”). Since the dispute arose between the territorial community and a legal entity regarding the recovery of a land plot, it is subject to consideration under commercial, rather than civil proceedings. In this case, the court deviated from previous practice and decided that the case should be transferred to the commercial court for further consideration.
