Ruling of the Grand Chamber of the Constitutional Court of Ukraine on Refusal to Satisfy the Petition of the Representative of the Constitutional Submission Subject Yulia Volodymyrivna Tymoshenko Regarding Recognition of Constitutional Proceedings in the Case of Constitutional Submissions by 48 People’s Deputies of Ukraine Concerning the Compliance with the Constitution of Ukraine (Constitutionality) of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding the Conditions of Circulation of Agricultural Land”, Certain Provisions of the Land Code of Ukraine as Amended by the Said Law, and 53 People’s Deputies of Ukraine Regarding the Compliance with the Constitution of Ukraine (Constitutionality) of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding the Conditions of Circulation of Agricultural Land” as Urgent

Ruling concerns the refusal to recognize as urgent the constitutional proceedings regarding the verification of the constitutionality of the Law on Agricultural Land Circulation based on the submission by people’s deputies. Structurally, the ruling consists of two main parts: 1) presentation of the essence of the request by Yulia Tymoshenko’s representative to recognize the case as urgent; 2) substantiation of the refusal to satisfy this request. Key provisions of the ruling:

• The issue of urgency must be considered simultaneously with determining the form of constitutional proceedings

• The Grand Chamber of the Constitutional Court of Ukraine previously changed the form of case consideration from oral to written, but did not consider the issue of urgency

• At the time of filing the request, the deadline for recognizing the case as urgent had already expired
