Subject of the dispute – challenging the ruling of the Appellate Chamber of the High Anti-Corruption Court on refusal to open appellate proceedings. The court established the presence of an exceptional legal issue or the need to deviate from the conclusion regarding the application of a legal norm in similar legal relations. For this reason, the panel of judges decided to transfer the case for consideration by the Joint Chamber of the Cassation Criminal Court, which has broader powers to resolve such issues.
Based on the results of reviewing the cassation appeal, the court ruled to transfer the criminal proceedings to the Joint Chamber of the Cassation Criminal Court of the Supreme Court.
