Order of the Ministry of Economy of Ukraine No. 22718 dated August 29, 2024 pertains to the approval of Amendments to the Regulations on the Governing Council of the National Standardization Body. This document introduces significant adjustments to the structure and functioning of the governing council aimed at enhancing its effectiveness and transparency.
Main Provisions of the Order:
1. Change in the Numerical Composition of the Governing Council
In Section II, paragraph 1, the number of members of the governing council has been reduced from twenty-one to eleven. Additionally, the number of representatives from each side has been decreased from four to two. This step is aimed at optimizing the council’s operations and facilitating the decision-making process.
2. Introduction of Qualification Requirements for Council Members
Paragraph 2 has been supplemented with new clauses that establish clear criteria for membership in the council:
- Possession of higher education.
- Experience in the field of standardization of no less than two years.
- Experience in managerial positions of no less than three years.
These requirements will ensure that the council comprises highly qualified specialists with substantial experience, positively impacting the quality of decisions made.
3. Role of the Head of the National Standardization Body in the Council
Paragraph 3 clarifies the status of the head of the national standardization body within the governing council. He is a council member but cannot be elected as its chair or vice-chair, does not preside over meetings, and does not participate in voting on certain issues related to the council’s authority. This promotes the prevention of conflicts of interest and ensures the independence of the council’s activities.
4. Procedure for Convening the First Meeting After the Council’s Formation
Paragraph 6 has been supplemented with a provision stating that after the composition of the governing council is formed, until the election of the chair and his deputies, the first meeting is convened and conducted by a representative of the Ministry of Economy of Ukraine. This ensures a prompt commencement of the work of the newly formed council.
5. Clarification of Conditions for Early Termination of Council Members’ Powers
Paragraph 9 has been expanded with details regarding the early termination of a member of the governing council’s powers. Powers may be terminated at the member’s personal request by submitting a statement or due to other circumstances that prevent the fulfillment of duties (for example, dismissal from office). The party that elected the council member must submit the relevant proposals to the council chair and the Ministry of Economy no later than the next working day after such circumstances arise.
6. Extension of the Term of Office for Council Members
In paragraph 10, the term of office for members of the governing council has been increased from two to three years. This will ensure continuity in the council’s work and the implementation of long-term projects.
7. Establishment of Quorum and Decision-Making Procedures
In Section IV, paragraph 8, it is established that the council meeting is deemed competent if at least eight members are present. Paragraph 10 specifies that decisions are made based on consensus. In the event that consensus cannot be reached, decisions are made by open voting and are considered adopted if at least six council members vote in favor. Each council member has one vote, and in the event of a tie, the vote of the chair is decisive.
8. Documentation and Publication of Council Decisions
Paragraph 12 stipulates that decisions of the governing council are formalized by minutes signed by the chair of the meeting and the secretary. A copy of the minutes is sent to all council members, the Ministry of Economy of Ukraine, and the national standardization body. The national standardization body is obliged to publish an excerpt of the minutes (the resolution part) on its official website, which enhances the transparency of the council’s activities.
