The Cabinet of Ministers of Ukraine adopted the resolution dated October 4, 2024, No. 1141, which amends the previous resolution of the Cabinet of Ministers dated December 5, 2018, No. 1029 “Certain Issues of the National Agency for Qualifications.”
The main provisions of this resolution include two key changes:
1. Change in the Maximum Number of Secretariat Employees
According to the new version of paragraph 3 of the resolution, the maximum number of employees of the Secretariat of the National Agency for Qualifications is established at 78 persons. Of these, 62 persons are financed from the general fund of the state budget, and 16 persons are financed from the special fund of the state budget.
2. New Version of the Statute of the National Agency for Qualifications
The Statute of the Agency is presented in a new version, which details its structure, powers, and organizational activities. The main provisions of the new Statute include:
General Part
- Status of the Agency: The National Agency for Qualifications (hereinafter referred to as the Agency) is a permanently functioning collegial body that performs functions in the field of qualifications as defined by the Law of Ukraine “On Education” and other legislative acts.
- Formation of the Agency: The Agency is formed from representatives of the Ministry of Education and Science, the Ministry of Economy, the joint representative body of all-Ukrainian associations of employers’ organizations, and the joint representative body of representative all-Ukrainian trade union associations.
- Principles of Activity: legality and integrity; professionalism; openness and transparency; impartiality and objectivity; non-discrimination; efficiency; collegiality and reasonableness of decision-making; state-community partnership.
- Interaction with Other Bodies: The Agency interacts with the Cabinet of Ministers of Ukraine, the Ministry of Education and Science, the Ministry of Economy, other central and local executive authorities, local self-government bodies, representative bodies of employers and trade unions, industry councils, and international organizations in the field of qualifications.
- Status of Legal Entity: The Agency is a non-profit institution, has the status of a legal entity of public law, an independent balance sheet, registration accounts, and a seal with its name.
Powers of the Agency
- Participation in the development of normative legal acts in the field of qualifications.
- Coordination of the activities of interested parties in the field of qualifications.
- Support for the National Qualifications Framework and its harmonization with international documents.
- International cooperation in the field of qualifications.
- Analysis and evaluation of the effectiveness of state policy in the field of qualifications.
- Participation in forecasting labor market needs for qualifications.
- Support for the information provision of the National Qualifications System.
- Creation and maintenance of the Qualifications Register.
- Development of draft procedures regarding professional standards and their submission for approval to the Cabinet of Ministers of Ukraine.
- Registration of professional standards and ensuring open access to them.
- Accreditation of qualification centers.
- Development of criteria and procedures for the recognition of professional qualifications obtained in other countries.
- Development of draft procedures regarding the assignment and confirmation of qualifications and their submission for approval to the Cabinet of Ministers of Ukraine.
Composition and Structure of the Agency
- Numerical Composition: 12 members, with three representatives from each submitting entity.
- Term of Office: 5 years with the possibility of re-election for one additional term.
- Requirements for Members: proficiency in the state language, higher education no lower than a master’s degree, general work experience in the profile of no less than five years.
- Restrictions: persons with a criminal record, conflicts of interest, or restrictions under the legislation cannot be members of the Agency.
Working Bodies of the Agency
- To exercise its powers, the Agency has the right to form committees.
- Committees may be permanent or temporary, consisting of members of the Agency and invited specialists.
- The organization of the work of the committees is determined by the order of work of the Agency.
Management of the Agency’s Activities
- Chairperson of the Agency: manages and organizes the work of the Agency, is elected for five years by secret ballot, and works on a permanent basis.
- Deputy Chairpersons: assist in management, must represent different submitting entities, and work on a permanent basis.
- Meetings: are held weekly, but no less than once a month; decisions are made if at least seven members vote in favor.
Secretariat of the Agency
- Provides organizational, financial, and other support for the activities of the Agency and its committees.
- Led by the head of the secretariat, who is appointed by the Chairperson of the Agency with the consent of the Agency.
- Secretariat employees work on a permanent basis, and their terms of remuneration are determined by legislation.
Property and Funds of the Agency
- Funding: is carried out at the expense of the state budget, grants, and other international donor assistance, and other sources not prohibited by law.
- Property: is state property, belongs to the Agency on the right of operational management, and is used in accordance with the statutory purposes.
Accounting and Reporting
- The Agency keeps records and develops reports in accordance with its powers.
- Annually, by March 1, it submits a report on the results of its activities for the previous year to the Cabinet of Ministers of Ukraine.
Termination of the Agency
- The Agency may be reorganized or liquidated in accordance with the legislation.
- Termination is carried out in the manner prescribed by law and is considered completed after the corresponding entry is made in the Unified State Register.
Thus, the new version of the Statute of the National Agency for Qualifications regulates its activities, structure, and powers in detail, defines management and funding mechanisms, and establishes the procedure for interaction with other bodies and organizations in the field of qualifications.
