This Order of the Ministry for Communities and Territories Development of Ukraine approves current amendments to the List of Territories where hostilities are (were) ongoing or which are temporarily occupied by the Russian Federation. The document serves as an instrument for the operational updating of the status of specific hromadas, which directly affects the legal regime of the territories. It ensures that the official list corresponds to the actual security situation on the ground.
The structure of the Order consists of an executive part, which defines the powers regarding the registration and publication of the amendments, and the annex containing the amendments to the List itself. The Order is based on Cabinet of Ministers Resolution No. 1364 dated December 6, 2022, which is fundamental to the formation of this registry. Compared to previous versions, this act introduces targeted adjustments to the list of territories previously approved by Order No. 376 dated February 28, 2025 (as amended on May 26, 2026).
The most important provisions for practical application are:
1. Updating the status of territories: the Order defines specific settlements or districts that are transitioning into the categories of territories of active hostilities, possible hostilities, or temporary occupation.
2. Legal significance: this List serves as the basis for the exercise of the rights of citizens and business entities to receive state benefits, compensation, tax preferences, and other social protection measures provided for residents and businesses in the zone of hostilities or occupation.
3. Timeliness: the Order enters into force from the day of its official publication, which requires the immediate consideration of the updated data by public authorities and local self-government bodies when calculating payments or applying special legal regimes.
