    ## On the Approval of the Procedure for Classifying Drinking Water as “Natural Mineral Water” Відповідно до статті 1 Закону України “Про питну воду, питне водопостачання та водовідведення”, підпункту 14 пункту 4 Положення про Міністерство охорони здоров’я України, затвердженого постановою Кабінету Міністрів України від 25 березня 2015 року № 112, з метою упорядкування нормативно-правової бази у сфері питної води та питного водопостачання НАКАЗУЮ: 1. Затвердити Порядок віднесення води питної до категорії “вода природна мінеральна”, що додається. 2. Визнати таким, що втратив чинність, наказ Міністерства охорони здоров’я України від 17 березня 2006 року № 120 “Про затвердження Державних гігієнічних правил і норм “Гігієнічні вимоги до води питної, призначеної для споживання людиною” ДСанПіН 2.2.4-171-10”, зареєстрований в Міністерстві юстиції України 07 квітня 2006 року за № 401/12275 (із змінами). 3. Директорату громадського здоров’я Міністерства охорони здоров’я України забезпечити подання цього наказу в установленому законодавством порядку на державну реєстрацію до Міністерства юстиції України. 4. Цей наказ набирає чинності з дня його офіційного опублікування. 5. Контроль за виконанням цього наказу покласти на заступника Міністра охорони здоров’я України згідно з розподілом обов’язків. МІНІСТЕРСТВО ОХОРОНИ ЗДОРОВ’Я УКРАЇНИ ЗАТВЕРДЖЕНО Наказ Міністерства охорони здоров’я України (Дата) № (Номер) ПОРЯДОК віднесення води питної до категорії “вода природна мінеральна” 1. Цей Порядок визначає процедуру віднесення води питної до категорії “вода природна мінеральна”. 2. Дія цього Порядку поширюється на суб’єктів господарювання незалежно від форми власності та підпорядкування, які здійснюють діяльність з видобування, обробки та розливу води питної, що претендує на віднесення до категорії “вода природна мінеральна” (далі – заявники). 3. Для віднесення води питної до категорії “вода природна мінеральна” заявник подає до Міністерства охорони здоров’я України (далі – МОЗ) такі документи: 1) заяву про віднесення води питної до категорії “вода природна мінеральна” за формою згідно з додатком 1 до цього Порядку; 2) копію висновку державної санітарно-епідеміологічної експертизи на відповідність води питної державним санітарним нормам і правилам; 3) копію протоколу досліджень води питної за показниками безпеки та якості, проведених акредитованою лабораторією, виданого не раніше ніж за 12 місяців до дати подання заяви; 4) науково-технічний звіт, що містить обґрунтування щодо віднесення води питної до категорії “вода природна мінеральна”, з урахуванням вимог до природної мінеральної води, визначених у нормативно-правових актах. 4. МОЗ протягом 30 календарних днів з дня отримання документів, зазначених у пункті 3 цього Порядку, розглядає їх та приймає рішення про віднесення води питної до категорії “вода природна мінеральна” або про відмову у такому віднесенні. 5. Підставами для відмови у віднесенні води питної до категорії “вода природна мінеральна” є: 1) подання неповного пакета документів, передбачених пунктом 3 цього Порядку; 2) виявлення у поданих документах недостовірної інформації; 3) невідповідність води питної вимогам до природної мінеральної води, визначених у нормативно-правових актах. 6. Рішення про віднесення води питної до категорії “вода природна мінеральна” оформлюється наказом МОЗ, який розміщується на офіційному вебсайті МОЗ. 7. У разі прийняття рішення про відмову у віднесенні води питної до категорії “вода природна мінеральна” МОЗ надсилає заявнику письмове повідомлення із зазначенням підстав для такої відмови. 8. Рішення МОЗ про віднесення води питної до категорії “вода природна мінеральна” може бути оскаржене в установленому законодавством порядку.
