Analysis of the Resolution of the Cabinet of Ministers of Ukraine dated October 15, 2024, No. 1174

The Resolution of the Cabinet of Ministers of Ukraine No. 1174 dated October 15, 2024, introduces amendments to the Procedure for the Use of Funds Allocated in the State Budget for the Execution of Court Decisions. Specific Changes
1. Replacement of the phrase “under the program” with “under the budget program”
In paragraph 1 of Resolution No. 1174, the term “under the program” is replaced with “under the budget program.” This clarification specifies the source of funding, emphasizing that the funds are used in accordance with the approved budget programs of the state.
2. Addition to paragraph 5 with a subparagraph regarding payments to veterans and victims of Nazi persecution
Paragraph 5 is supplemented with a new subparagraph, which provides for:
- Ensuring the fulfillment of monetary obligations for one-time cash payments to war veterans and victims of Nazi persecution on Independence Day of Ukraine in accordance with the Law of Ukraine “On the Status of War Veterans, Guarantees of Their Social Protection” and “On Victims of Nazi Persecution.”
- Compensation for moral damages and legal costs incurred based on court decisions made by national courts, for debtors, in the execution of which the Pension Fund of Ukraine and/or territorial bodies of the Pension Fund of Ukraine are designated.
These additions expand the functionality of the Procedure, including additional financial obligations for supporting veterans and victims of persecution, as well as providing mechanisms for the reimbursement of legal expenses.
3. Changes in paragraphs 10 – 1
In the first and second paragraphs of 10 – 1, the verbal expression and numbers are changed from “in subparagraphs 2, 3 – 1 and 4” to “in subparagraphs 2, 3 – 1, 4 and 5.” This means that additional subparagraphs are involved in the regulation, expanding the range of regulated issues.
4. Change in paragraph 16 regarding accounts
In paragraph 16, the term “opening of accounts” is changed to “opening and closing of accounts.” This addition provides for a more comprehensive regulation of the account management process, including not only their opening but also their closing, which contributes to the transparency and efficiency of financial operations.

Resolution No. 1174 introduces important clarifications and additions to the previous Procedure for the Use of Funds to Ensure the Execution of Court Decisions.
