Main Arguments of the Court: The Supreme Court established that until July 19, 2022, the Labor Code did not contain restrictions on the time limit for an employee to file a lawsuit for recovering due wages. The court emphasized the need for a clear delineation of the scope of legal norms in time and concluded that the appellate court incorrectly applied labor law provisions, which led to an erroneous conclusion about the missed deadline.

Court Decision: Satisfy the cassation complaint, cancel the appellate court’s ruling, and refer the case for a new review to the appellate administrative court.
