The Cabinet of Ministers of Ukraine Resolution No. 1147 introduced a number of amendments to the existing Postal Services Provision Rules, previously approved. 1. Amendments to the second paragraph of point 16

In the second paragraph of point 16, the phrase “notification of delivery” has been supplemented with the words “marked ‘TCU Summons’, ‘Deliver personally’”. This means that the category of delivery notifications now includes special markings indicating the necessity for personal delivery of documents to the addressee or compliance with certain requirements of the TCU (Territorial Credit Center).

2. Amendments to the first paragraph of point 81

The words “marked ‘Court Summons’” have been changed to “marked ‘Court Summons’, ‘TCU Summons’”. This expands the classification of court documents that are subject to special delivery procedures, including the new category “TCU Summons”.

3. Amendments to point 82

  1. A new paragraph has been added:

    “Recommended letters marked ‘TCU Summons’ when delivered to the specified address are handed personally to the addressee (recipient). In the absence of the addressee (recipient) at the address specified on the recommended letter, the postal employee informs the addressee (recipient) using the available phone number and/or places a notice of the arrival of the recommended letter marked ‘TCU Summons’ in their mail box.”

    This paragraph regulates the procedure for the delivery of recommended letters marked “TCU Summons”, providing for personal delivery to the addressee and an information procedure in case of their absence.

    Consequently, the second paragraph becomes the third, contributing to a better structuring of the rules.

  2. Another paragraph has been added:

    “If within three working days after notification by the postal service the addressee (recipient) does not appear to collect the recommended letter marked ‘TCU Summons’, the postal employee makes a note ‘addressee absent at the specified address’, which is certified by their signature with the imprint of the postal device, the use of which is established by the designated postal operator, and no later than the next working day returns such a letter to the sender.”

    This paragraph establishes a specific timeframe (three working days) for the addressee to appear for the letter after receiving the notification. In the event of their absence, the letter is returned to the sender with appropriate markings, ensuring control over delivery and the regulation of the addressee’s obligations regarding the receipt of mail.

4. Amendments to point 85

A line has been added to point 85: “Recommended letters marked ‘TCU Summons’, ‘Deliver personally’ are to be handed personally to the addressees.” This emphasizes the necessity of personal delivery of such letters, preventing their transfer to other individuals or leaving them in the mailbox.

5. Amendments to point 91

  1. In the second paragraph, the words “marked ‘Court Summons’” have been changed to “marked ‘Court Summons’, ‘TCU Summons’”. This expands the list of documents subject to special delivery procedures.

  2. In the fourth paragraph, the words “marked ‘Court Summons’” have been changed to “marked ‘Court Summons’, ‘TCU Summons’”, and the words “to the court” have been replaced with “to the sender”. This means that in case of impossibility to deliver such documents, they are returned not only to the court but also to the sender.

6. Amendments to point 99

  1. In the third paragraph, the words “marked ‘Court Summons’” have been replaced with “marked ‘Court Summons’, ‘TCU Summons’”. This is similar to point 91, expanding the list of markings.

  2. In the fourth paragraph, the words “marked ‘Court Summons’” have been replaced with “marked ‘Court Summons’, ‘TCU Summons’”, and the words “to the court” have been changed to “to the sender”. This ensures the return of documents both to the court and to their owner in case of impossibility to deliver.

7. Amendments to point 101

In the third paragraph of point 101, the words “marked ‘Court Summons’” have been changed to “marked ‘Court Summons’, ‘TCU Summons’”. This ensures uniform standards for different types of court summonses.

8. Amendments to point 108

In the seventh paragraph of point 108, the words “marked ‘Court Summons’” have been replaced with “marked ‘Court Summons’, ‘TCU Summons’”. This corresponds to the previous amendments, unifying the delivery processes of various types of summonses.
