The court was guided by the following considerations: 1) legislation does not provide for such a method of protection as compensation for moral damages for filing an appellate complaint in another case; 2) disagreement with the appellate complaint must be expressed in a procedural manner within the case in which it was filed; 3) the absence of a real dispute about the right excludes the possibility of appealing to the court. The Supreme Court deviated from previous practice and formulated new legal conclusions regarding the interpretation of cases that are not subject to judicial review.
