    Case No. 1.380.2019.003907 dated 16/01/2025

    Subject of the dispute – challenging the remarks of the Lviv Mayor to the city council resolution on changing the land plot’s intended purpose. The Supreme Court deviated from previous practice and indicated that the mayor’s remarks to council decisions cannot be a subject of judicial review, as these are his discretionary powers. The Court also noted that the reasonableness of such remarks should be verified not by the court, but by the council itself through a repeated review of the suspended decision. Additionally, the court took into account that the plaintiff died during the case proceedings, and such legal relations do not allow legal succession.

    As a result, the Supreme Court reversed the decisions of the previous instances and closed the proceedings in the case.
