Review of Ukrainian legislation for 28/12/2024

Changes in the Social Sphere:

– When calculating the average monthly family income for social assistance, “net” salary after personal income tax and military levy deduction is now considered, not the full amount.
– 74.6 million UAH in subvention to local budgets has been allocated for improving hot meal quality for primary school students, funds can be used for new ingredients and reducing parental co-payment.
– 24.5 million UAH from the reserve fund has been allocated to compensate expenses for institutions that provided free accommodation to internally displaced persons in September 2024.

Changes in the Medical Sphere:

– The frequency of mandatory medical examinations for certain employee categories has been changed from annual to once every 5 years.
– Approaches to cancer prevention and early diagnosis have been updated, including new screening programs for breast and cervical cancer.
– Prostate cancer screening has been excluded from mandatory examination programs.

Changes in Security and Defense:

– The procedure for purchasing domestic unmanned systems and electronic warfare means has been approved, with advance payment up to 70% allowed for up to 12 months.
– The document processing procedure for special police unit injuries during martial law has been simplified.
– Financing for the State Special Communication representative at the NATO Cyber Defense Center has been expanded, with annual financial contribution coverage added.

Changes in Science and Education:

– A new methodology for evaluating scientific institutions’ effectiveness has been approved, considering quantitative indicators and expert evaluation.
– The procedure for expert groups’ work in state certification of scientific institutions has been determined.
– The National Aviation University has been renamed to “State University ‘Kyiv Aviation Institute'”.

On the Accounting Price of Banking Metals

This is a daily notification from the National Bank of Ukraine establishing accounting prices for banking metals as of 27.12.2024. The document sets accounting prices for four types of banking metals: gold, silver, platinum, and palladium. Prices are indicated per one troy ounce of each metal in hryvnias.

Key provisions:
– Gold (XAU) – 109,909.71 UAH per ounce
– Silver (XAG) – 1,244.72 UAH per ounce
– Platinum (XPT) – 39,368.33 UAH per ounce
– Palladium (XPD) – 39,477.96 UAH per ounce

It is important to note that these prices are reference prices, and the NBU does not undertake to conduct transactions with banking metals at the specified prices.

On the Official Exchange Rate of Hryvnia to Foreign Currencies

This is a daily notification from the National Bank of Ukraine establishing the official exchange rate of hryvnia to 35 foreign currencies as of 27.12.2024. The document contains a table with currency rates, where for each currency its digital and literal code, number of units, full name, and official rate relative to hryvnia are indicated. Among the main currencies: US dollar – 41.8447 UAH, euro – 43.5122 UAH, pound sterling – 52.3896 UAH.

Key provisions:
– Rates are used for accounting purposes
– Applied for NBU operations with the State Treasury Service of Ukraine
– NBU does not undertake to buy or sell currencies at the specified rates
– Rates are set for the most important currencies for the Ukrainian economy, including currencies of main trading partners

On Amendments to the Regulation on Inclusive Resource Center

The resolution amends the Regulation on Inclusive Resource Center, expanding its functions and modernizing terminology. The main changes relate to broadening the circle of persons receiving services and clarifying the procedure for center operations.

Structurally, the changes cover 17 points and concern both the main text of the Regulation and its appendices. Key changes include: replacing the term ‘children’ with ‘persons’, adding professional pre-higher education institutions to the list of institutions, expanding opportunities for choosing an inclusive resource center, updating the list of documentation.

Most important provisions for practical application:
– Possibility of contacting the nearest center in the absence of a center at the place of residence
– Extension of comprehensive assessment period to 30 days in case of person’s illness
– Maintaining documentation in both electronic and paper form
– Expanding requirements for the center’s head – added possibility of professional work experience

On Amendments to the Cabinet of Ministers of Ukraine Resolution of March 5, 2024 No. 247

The resolution amends the procedure for allocating funds from the fund for eliminating consequences of armed aggression, reducing the total financing volume from 7.95 billion UAH to 7.45 billion UAH.Financing for certain projects in Kyiv, Kharkiv, and Chernihiv regions has been reduced. The document is structurally composed of two parts: the main text of the resolution and an appendix with amendments. The main text contains instructions for the Ministry of Regional Development to coordinate changes with the relevant parliamentary committee. The appendix details changes in financing for specific objects and territorial communities.

The main changes concern supplementing the list of necessary information when transferring objects and establishing a prohibition on transferring material carriers of secret information.

Key innovations:
– When transferring state-owned property, it is now mandatory to provide information about the presence of material carriers of secret information;
– A direct prohibition has been established on transferring material carriers of secret information to the State Property Fund;
– When transferring corporate rights, it is also necessary to provide information about the presence of material carriers of secret information in the economic entity.

On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine on State Registration

The resolution amends the state registration procedure in connection with the adoption of the Law of Ukraine “On Agricultural Notes”. The main changes concern three registers: the State Register of Movable Property Encumbrances, the State Register of Civil Status Acts, and the State Register of Real Property Rights. Structurally, the resolution consists of three blocks of changes. The most significant changes were made to the Procedure for Maintaining the State Register of Movable Property Encumbrances – added the possibility of registering encumbrances for agricultural notes, defined features of electronic interaction through the “Trembita” system, and established a procedure for identifying property through the land plot cadastral number. Key innovations:
– Electronic registration of movable property encumbrances for agricultural notes is introduced;
– The possibility of obtaining information about marriage/divorce for persons intending to issue an agricultural note is established;
– A requirement is introduced to obtain the consent of the agricultural note creditor for operations with the land plot where the pledged agricultural products are grown.

On the Procedure for Registering Movable Property Encumbrances in Connection with Temporary Restricted Access to the State Register of Movable Property Encumbrances

The resolution establishes a temporary procedure for registering movable property encumbrances under conditions of limited access to the State Register of Movable Property Encumbrances. The document defines a mechanism for registering encumbrances without directly entering records in the register and the procedure for subsequent data entry after access is restored. Structurally, the resolution consists of three points regulating: features of encumbrance registration during the period of limited access, the procedure for providing information about registered encumbrances, and determining the date of registry access restoration. This is a new document that introduces a temporary procedure.Key Provisions of the Registry Operation Mechanism in Special Conditions:

1. Registration of encumbrances is carried out by the registry holder without making entries in the registry itself
2. Priority of encumbrances is maintained according to the order of their registration
3. After the registry’s restoration, all entries will be made while preserving the original registration date
4. Information about registered encumbrances is provided upon request in the form of a letter from the registry holder

Resolution on Amending the Point 3 of the Cabinet of Ministers of Ukraine Resolution from February 17, 2023 No. 142

The resolution introduces changes regarding financing for the State Special Communications Representative in the NATO Cyber Defense Advanced Technologies Joint Center. The main change involves expanding the list of expenses covered from the state budget. The document structurally contains only one amendment to point 3 of resolution No. 142 from 17.02.2023, which adds an annual financial contribution for the State Special Communications representative in the NATO Center.

The key provision is that in addition to expenses for maintaining the representative and social insurance for family members, the state will now also cover the annual financial contribution for the representative’s participation in the NATO Cyber Defense Joint Center.

Resolution on Amendments to the Organizational and Technical Cyber Protection Model Regulation

The resolution amends the 2021 Organizational and Technical Cyber Protection Model Regulation, updating terminology and clarifying cyber protection mechanisms in Ukraine. Key provisions include:

– Detailed definition of basic cyber protection measures: management, identification, protection, detection, response, and recovery
– The National Bank received powers to approve cyber protection procedures for banks and financial institutions
– Expanded powers of cyber protection forces to analyze effectiveness and adjust cyber protection measures
– Clarified interaction mechanisms between different cyber protection system entities

Resolution on Amending the Procedure for Calculating Average Monthly Total Family Income for All Types of State Social Assistance

The resolution changes the procedure for calculating the average monthly total family income when assigning state social assistance. Henceforth, wages will be considered “net” – that is, after deducting personal income tax and military levy.
