    On Adoption as a Basis of the Draft Law of Ukraine on Amendments to the Criminal Procedure Code of Ukraine and Other Laws of Ukraine Regarding the Optimization of Processes for Searching for Missing Persons and Identifying Unidentified Bodies (Remains) During Martial Law

    This resolution of the Verkhovna Rada of Ukraine concerns the adoption as a basis of a draft law aimed at optimizing the processes of searching for missing persons and identifying unidentified bodies (remains) under martial law.

    The structure of the resolution consists of two points: the first is the adoption as a basis of the draft Law of Ukraine (reg. No. 14095), submitted by People’s Deputies, and the second is the instruction to the Committee of the Verkhovna Rada of Ukraine on Law Enforcement to finalize the draft law, taking into account the proposals, and submit it for consideration in the second reading.

    The main provision is that the Verkhovna Rada of Ukraine supports the need to amend the Criminal Procedure Code of Ukraine and other laws of Ukraine to improve the search for missing persons and the identification of unidentified bodies, especially under martial law. This means that the draft law will be finalized and considered for possible adoption in the future.

    **On Approval of Amendments to the Criteria by Which Enterprises, Institutions, and Organizations of Significance to the National Economy in the Field of Culture Are Determined** Відповідно до пункту 2 Порядку та критеріїв визначення підприємств, установ та організацій, які мають важливе значення для національної економіки, підприємств, установ та організацій, які задовольняють потреби оборони держави, затверджених постановою Кабінету Міністрів України від 27 січня 2023 року № 76 «Деякі питання реалізації положень Закону України «Про мобілізаційну підготовку та мобілізацію» щодо бронювання військовозобов’язаних на період мобілізації та на воєнний час», **НАКАЗУЮ:** 1. Затвердити Зміни до Критеріїв, за якими здійснюється визначення підприємств, установ та організацій, які мають важливе значення для галузі національної економіки в сфері культури, затверджених наказом Міністерства культури та інформаційної політики України від 31 січня 2023 року № 52, зареєстрованих в Міністерстві юстиції України 22 лютого 2023 року за № 325/39381, що додаються. 2. Державному секретарю Міністерства культури та інформаційної політики України забезпечити подання цього наказу на державну реєстрацію до Міністерства юстиції України в установленому порядку. 3. Контроль за виконанням цього наказу покласти на заступника Міністра, відповідно до розподілу обов’язків. 4. Цей наказ набирає чинності з дня його офіційного опублікування. **Міністр** **ЗАТВЕРДЖЕНО** **Наказ Міністерства культури та інформаційної політики України** **ЗМІНИ,** **що вносяться до Критеріїв, за якими здійснюється визначення підприємств, установ та організацій, які мають важливе значення для галузі національної економіки в сфері культури** 1. Пункт 1 викласти в такій редакції: «1. Відповідність підприємства, установи, організації одному із таких критеріїв: 1) підприємство, установа, організація є об’єктом національного культурного надбання; 2) підприємство, установа, організація має важливе значення для розвитку відповідної галузі національної економіки чи адміністративно-територіальної одиниці, що підтверджується одним з таких показників: сума сплачених податків, зборів, платежів до державного і місцевих бюджетів, крім митних платежів, та сума сплаченого єдиного внеску на загальнообов’язкове державне соціальне страхування протягом звітного податкового року становить не менше ніж 1,5 мільйона гривень; отримання фінансової підтримки з державного або місцевого бюджету (крім коштів, отриманих як оплата за надані послуги (виконані роботи) за державним чи місцевим замовленням, зокрема за рахунок публічних закупівель) протягом звітного податкового року; здійснення надання соціально важливих послуг населенню, які забезпечують його життєві потреби; провадження діяльності у сфері культури, креативних індустрій (за КВЕД ДК 009:2010) та/або інформаційній сфері.». 2. Пункт 2 виключити. Pursuant to paragraph 2 of the Procedure and Criteria for Determining Enterprises, Institutions, and Organizations of Significance to the National Economy, Enterprises, Institutions, and Organizations That Meet the Needs of the State’s Defense, approved by постановa of the Cabinet of Ministers of Ukraine No. 76 dated January 27, 2023, “Some Issues of Implementation of the Provisions of the Law of Ukraine “On Mobilization Preparation and Mobilization” Regarding the Reservation of Those Liable for Military Service for the Period of Mobilization and Wartime,” **HEREBY ORDER:** 1. To approve the Amendments to the Criteria by Which Enterprises, Institutions, and Organizations of Significance to the National Economy in the Field of Culture Are Determined, approved by order of the Ministry of Culture and Information Policy of Ukraine No. 52 dated January 31, 2023, registered with the Ministry of Justice of Ukraine on February 22, 2023, under No. 325/39381, which are attached. 2. The State Secretary of the Ministry of Culture and Information Policy of Ukraine shall ensure the submission of this order for state registration to the Ministry of Justice of Ukraine in accordance with the established procedure. 3. Control over the execution of this order shall be assigned to the Deputy Minister, according to the distribution of responsibilities. 4. This order shall enter into force from the date of its official publication. **Minister** **APPROVED** **By Order of the Ministry of Culture and Information Policy of Ukraine** **AMENDMENTS** **to the Criteria by Which Enterprises, Institutions, and Organizations of Significance to the National Economy in the Field of Culture Are Determined** 1. Clause 1 shall be stated as follows: “1. The enterprise, institution, organization meets one of the following criteria: 1) the enterprise, institution, organization is an object of national cultural heritage; 2) the enterprise, institution, organization is of significant importance for the development of the relevant sector of the national economy or administrative-territorial unit, which is confirmed by one of the following indicators: the amount of taxes, fees, payments to the state and local budgets, excluding customs payments, and the amount of single contribution to mandatory state social insurance paid during the reporting tax year is not less than 1.5 million hryvnias; receipt of financial support from the state or local budget (except for funds received as payment for services provided (works performed) under a state or local order, in particular at the expense of public procurement) during the reporting tax year; provision of socially important services to the population that ensure its vital needs; carrying out activities in the field of culture, creative industries (according to NACE Rev. 2 code 90.0) and/or the information sphere.”. 2. Clause 2 shall be excluded.
