Analysis of the Order of the Ministry of Internal Affairs of Ukraine No. 589 dated August 28, 2024
General Provisions
The Order of the Ministry of Internal Affairs of Ukraine No. 589 approves amendments to the Regulations on the functional subsystem “Unified Register of Weapons” (URW) of the unified information system of the Ministry of Internal Affairs. The amendments were made in accordance with the Order of the Ministry of Internal Affairs No. 637 dated September 19, 2024, and come into effect upon official publication.
Amendments to the Regulations
Amendments to the Regulations, previously approved by the Order of the Ministry of Internal Affairs of Ukraine dated January 10, 2022, No. 2, have been approved. The changes concern both the structure and content of the Regulations, including clarifications of terminology and the addition of new provisions aimed at improving the process of information entry into the URW.
Editing of Section I
- In paragraph 2, changes were made to the terminology, replacing the word “series” with “serial.”
- In paragraph 2, item 11, the term “On Electronic Trust Services” was clarified to “On Electronic Identification and Electronic Trust Services.”
Items 4-9
Definitions of the owner, holder, and administrator of the URW have been introduced. The owner of the register is the state represented by the Ministry of Internal Affairs, the holder is the Ministry of Internal Affairs, and the administrator is a state enterprise that belongs to the sphere of management of the Ministry of Internal Affairs. The subjects of the URW are defined as various divisions of the Ministry of Internal Affairs and authorized legal and natural persons.
Functions of the URW Subjects
The functional responsibilities of each subject have been defined, including the entry of information, control over the circulation of weapons, formation of classifiers, and so on. The procedure for electronic information interaction through the central subsystem of the Unified Information System of the Ministry of Internal Affairs or the “Trembita” system is also established, in compliance with the requirements of relevant laws.
Information Security and Protection
Provisions regulating the protection of information in the URW have been added, including a set of technical, cryptographic, and organizational measures. The processing and protection of information are carried out in accordance with relevant laws on the protection of personal data and information.
Functioning of the URW
A round-the-clock operation mode for the URW has been established, with exceptions for planned and unplanned technical works. Information about the conduct of works is published on the official website of the Ministry of Internal Affairs three days before their commencement, except in urgent cases.
Interaction with Other Information Resources
The procedure for electronic interaction of the URW with other state information resources through software interfaces has been defined. The volume and structure of the exchanged data are regulated by agreements or separate protocols.
Access to the URW
The procedure for submitting requests for granting and terminating access to the URW is described. Requests are submitted in paper or electronic form and are considered by authorized divisions of the Ministry of Internal Affairs within established timeframes. Access is regulated based on licenses and permits related to the circulation of weapons and explosive materials.
Duration and Termination of Access
Access is granted for a period of one year and may be terminated in case of inactivity for two months. Renewal or extension of access is carried out according to established procedures.
Appendices to the Regulations
New versions of Appendices 1 and 2, which contain templates for requests for granting and terminating access to the URW, are attached to this Order.
Funding of the URW
The functioning of the URW is financed from the state budget, funds of self-regulating organizations, international financial assistance, and other sources not prohibited by law.
Final Provisions
The Order comes into effect from the day of its official publication and is registered with the Ministry of Justice of Ukraine on September 13, 2024, under number 1384/42729.
