Subject of Dispute: Challenging the State Executor’s Ruling on Initiating Enforcement Proceedings for Alimony Collection.

Main Arguments of the Court: The Supreme Court supported the position of the appellate court that the state executor is not obligated to additionally verify the debtor’s place of residence when initiating enforcement proceedings. The court proceeded from the fact that the court order and the claimant’s application indicated the same address of the debtor, and there was no evidence that the executor was aware of another address. Moreover, on February 27, 2024, the executor had already transferred documents to the debtor’s registered place of residence.

Court Decision: The cassation complaint shall be left without satisfaction, the appellate court’s ruling shall remain unchanged.
