This order of the Ministry of Justice introduces technical amendments to a number of regulatory acts governing the activities of the executive service and private executors in Ukraine.
Structurally, the order consists of a main part and an appendix with amendments to 7 regulatory legal acts of the Ministry of Justice. The main changes relate to the transfer of powers to approve the list of combat territories from the Ministry of Reintegration to the Ministry of Regions, as well as replacing the word “Jurisprudence” with “Law” in documents.
Key provisions:
1. The procedure for accessing the automated executive proceedings system during martial law has been updated
2. The list of information entered into executive proceedings has been expanded (information about partial execution of the decision by the debtor has been added)
3. The procedure for replacing private executors has been clarified, particularly regarding access to accounts
4. The procedure for coordinating the nomenclature of a private executor’s cases with justice authorities has been changed
5. Requirements for education of candidates for positions in the executive service system have been updated
– since the changes relate to executive proceedings, which are part of procedural legislation.
