Essence of the Act:
\nThe Order of the State Property Fund of Ukraine establishes criteria for identifying enterprises that are of significant importance to the economy during a special period. The document defines 6 main criteria, and if an enterprise meets at least one of them, it is considered important for the national economy during a special period.<\/p>\n
Structure and Main Provisions:
\n1. The order consists of the main part and an appendix with criteria
\n2. Cancels the previous order dated 31.05.2023
\n3. Criteria apply to enterprises under the management of the State Property Fund or where the State Property Fund manages state corporate rights<\/p>\n
Key Provisions for Application:
\n– Enterprises with assets from 1 million UAH, for which a privatization decision has been made
\n– Enterprises under sanctions
\n– Agricultural enterprises with an area of 80 hectares or more, or from 500 hectares (if in the State Agrarian Register)
\n– Enterprises executing contracts for construction and repair of infrastructure, civil protection facilities, territorial defense
\n– Enterprises in the fields of electricity, gas supply, water supply, waste management (specific economic activity codes are provided)
\n– Operators of critical infrastructure facilities of I-III criticality levels<\/p>\n
