Subject of the dispute: refusal of the Pension Fund of Ukraine to index the plaintiff’s pension by applying increase coefficients in 2022-2024. The court was guided by the following: 1) Procedure No. 124 contradicts Law No. 1058-IV in terms of applying the base indicator of average salary as of 01.10.2017; 2) indexation should use the average salary indicator that was considered when the pension was assigned; 3) the right to indexation is limited by a 6-month period for filing a lawsuit. The Supreme Court partially granted the claim, obliging the PFU to carry out indexation of the plaintiff’s pension from 17.11.2023 by applying the relevant increase coefficients.<\/p>\n
