The main focus of the document is directed towards improving the conditions of payments for war veterans, regulating the mechanism of payments during the period of investigation of occupational accidents, as well as reforming the system of providing social services and compensation to victims. In fact, the draft proposes a detailed algorithm of interaction between the employer, the insured person, and state bodies upon the occurrence of insured events.<\/p>\n<h3>Structure of the draft law and key changes compared to the current version<\/h3>\n<p>The draft law proposes to amend three key articles of the Law of Ukraine &#8220;On Compulsory State Social Insurance&#8221;:<\/p>\n<ul>\n<li><strong>Article 12 (Right to insurance benefits):<\/strong> The current legislation limits the amount of temporary disability benefit (not exceeding the minimum wage) and pregnancy and childbirth benefit (not exceeding twice the amount of the minimum wage) if the person&#8217;s insurance record over the last 12 months is less than 6 months. The draft law changes this rule for combat participants and persons with disabilities resulting from war. For them, the calculation period within which the existence of the 6-month insurance record is verified is increased from 12 to 24 months preceding the occurrence of the insured event.<\/li>\n<li><strong>Article 30 (Grounds for benefits):<\/strong> A provision has been added that clearly defines that prior to the completion of the official investigation of an occupational accident, temporary disability benefit shall be paid on the basis of a certificate of incapacity for work, taking into account new specific features prescribed inArticle 36.<\/li>\n<li><strong>Article 36 (Monthly insurance payments and compensation for damage):<\/strong> This Article has undergone the most significant structural changes. It is supplemented by a detailed step-by-step mechanism for the payment of sick leave benefits during the investigation of an accident, rules of compensation to the employer, as well as a completely new block on the provision of social care services and the payment of monetary compensations in lieu thereof.<\/li>\n<\/ul>\n<h3>Key provisions of the draft, important for key stakeholders<\/h3>\n<p>To facilitate understanding of the proposed innovations, they can be divided by categories of interest:<\/p>\n<h4>1. For citizens (insured persons, veterans, and victims of accidents at work)<\/h4>\n<ul>\n<li><strong>Preferential terms for veterans:<\/strong> Combatants and persons with disabilities as a result of war receive more lenient requirements for the insurance record to receive payments in full (the record for 24 months is analyzed, rather than for 12).<\/li>\n<li><strong>Continuity of payments:<\/strong> The right to receive sick leave benefits even before the completion of the investigation of an accident at work is enshrined.<\/li>\n<li><strong>Choice of the form of social services:<\/strong> Victims who require care by others or domestic services obtain the right of choice: either to receive services from professional providers, or to receive a monthly monetary compensation if such care is provided by a family member or another person.<\/li>\n<li><strong>Fixed amounts of care compensations:<\/strong> The amount of monthly monetary compensation for the provision of home care services by relatives is established at the level of:\n<ul>\n<li>100% of the minimum wage \u2014 for the need for special medical care;<\/li>\n<li>50% of the minimum wage \u2014 for the need for\n<p><a href=\"https:\/\/itd.rada.gov.ua\/billInfo\/Bills\/Card\/70196\"><strong>Full text by link<\/strong><\/a><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Analysis of the draft law: Substance of the draft law This draft law is aimed at reforming the system of compulsory state social insurance in terms of strengthening the protection of certain categories of citizens.
