1. The subject of the dispute is the cancellation of the order of the Ministry of Justice of Ukraine on satisfying the complaint regarding the cancellation of the state registration of ownership of real estate.<\/p>\n

The Supreme Court overturned the decisions of the previous instances, guided by the fact that the courts did not take into account the legal position of the Grand Chamber of the Supreme Court regarding the subject composition of the parties in disputes regarding the cancellation of orders of the Ministry of Justice of Ukraine, namely that the proper defendant in such a case is the person whose right to property is disputed, and not only the Ministry of Justice. The court noted that the plaintiff did not involve the person whose right is disputed in the case, and insisted on satisfying the claims only against the Ministry of Justice, with which he has no dispute about property rights. Also, the court took into account that at the time of filing the lawsuit, bankruptcy proceedings were initiated against the person whose right is disputed, which provides for a special legal regime and concentration of disputes within the framework of the bankruptcy case. The court departed from the previous conclusions of the Commercial Cassation Court within the Supreme Court regarding the subject composition of the parties in such disputes, taking into account the conclusions of the Grand Chamber of the Supreme Court.<\/p>\n
3. The court overturned the decisions of the previous instances and refused to satisfy the claim for cancellation of the order of the Ministry of Justice of Ukraine.<\/p>\n
