1. The subject of the dispute is the appeal against the refusal of the Main Department of the Pension Fund of Ukraine to conduct pension indexation by applying the increase coefficients of the average salary (income) indicator in Ukraine.<\/p>\n

The court of cassation instance, satisfying the claim requirements, emphasized that pension indexation is an integral part of pension payments, aimed at maintaining the purchasing power of the population in the face of rising prices. The Supreme Court emphasized that the Cabinet of Ministers of Ukraine, although it has the authority to determine the indexation procedure, cannot establish a basic calculation value that negates the main purpose of indexation. The court noted that when recalculating the pension, the average salary indicator, which was directly taken into account when assigning the pension, should be used, and not as of 01.10.2017, as provided for by Procedure No. 124. The court also indicated that each subsequent recalculation of the pension should take into account the increase coefficients applied during indexation in previous years. Thus, the Main Department of the Pension Fund of Ukraine acted unlawfully by not applying the increase coefficients to the average salary indicator of the plaintiff. The court deviated from the previous position regarding the application of the provisions of Procedure No. 124.<\/p>\n
3. The court of cassation instance overturned the decision of the court of appeal instance and upheld the decision of the court of first instance, satisfying the claim requirements of the pensioner.<\/p>\n
